Agreement and Acceptance

Welcome to TechForge Academy. These Terms of Use ("Terms") constitute a legally binding agreement between you and TechForge Academy, located at Abay Ave 45, Almaty, Kazakhstan, governing your access to and use of our website, mobile applications, services, and educational content related to industrial technology, smart manufacturing, CNC systems, robotics engineering, automation, mechanical innovation, and Industry 4.0 technologies (collectively, the "Services"). By accessing, browsing, registering for, or using our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, incorporated herein by reference. If you do not agree to these Terms, you must immediately discontinue use of our Services. You represent and warrant that you have the legal capacity to enter into this agreement and are at least 16 years of age. If you are accessing our Services on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

Account Registration and User Responsibilities

To access certain features of our Services, you must create an account by providing accurate, current, and complete information including your name, email address, and other required details. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You may not transfer, sell, or share your account with others, or create multiple accounts for fraudulent purposes. You agree to provide truthful information about your educational background, professional experience, and qualifications when required for course enrollments or certifications. You are responsible for ensuring that your use of the Services complies with all applicable laws and regulations in your jurisdiction. You must not use automated systems (bots, scrapers) to access our Services without express written permission. TechForge Academy reserves the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or pose security risks to our platform or other users.

Intellectual Property Rights and Content Ownership

All content, materials, and resources available through TechForge Academy Services, including but not limited to course materials, videos, tutorials, assessments, documentation, graphics, logos, software, source code, technical specifications, engineering diagrams, and text related to industrial technology and smart manufacturing (collectively, "Content"), are the exclusive property of TechForge Academy or our licensors and are protected by international copyright, trademark, patent, and other intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Content solely for your personal educational purposes in accordance with these Terms. You may not reproduce, distribute, modify, create derivative works, publicly display, republish, download, store, transmit, sell, or commercially exploit any Content without our express written permission. User-generated content submitted through forums, discussions, or assignments remains your property, but you grant TechForge Academy a worldwide, royalty-free license to use, reproduce, and display such content for educational and promotional purposes. Any feedback, suggestions, or ideas you provide become our property without compensation or attribution obligations.

Course Enrollment, Payments, and Refund Policy

When you enroll in paid courses or subscription programs, you agree to pay all applicable fees as described at the time of purchase. All prices are listed in the displayed currency and are subject to change with prior notice. Payment processing is handled through secure third-party payment processors, and you authorize us to charge your selected payment method. Fees are non-refundable except as expressly provided in our refund policy or required by law. Refund requests must be submitted within 14 days of purchase for eligible courses, provided you have accessed less than 20% of the course content. Refunds are processed within 30 business days to the original payment method. Subscription services automatically renew unless cancelled at least 24 hours before the renewal date through your account settings. We reserve the right to modify course pricing, content, structure, or availability at any time. Course completion does not guarantee employment, certification, or specific career outcomes. Certificates of completion are issued only upon successful completion of all course requirements and assessments. TechForge Academy reserves the right to revoke certificates if fraud, plagiarism, or Terms violations are discovered.

Prohibited Conduct and User Obligations

Users must conduct themselves professionally and ethically when using our Services. Prohibited activities include: violating any applicable laws or regulations; infringing intellectual property rights of TechForge Academy or third parties; sharing course materials, login credentials, or proprietary content with unauthorized individuals; engaging in academic dishonesty, plagiarism, or cheating on assessments; submitting false, misleading, or fraudulent information; harassing, threatening, or abusing other users or instructors; posting offensive, discriminatory, defamatory, or inappropriate content; uploading malware, viruses, or harmful code; attempting to gain unauthorized access to our systems or other users' accounts; interfering with platform security features or circumventing access controls; using our Services for unauthorized commercial purposes or competitive intelligence; impersonating others or misrepresenting your affiliation with any organization; data mining, scraping, or collecting user information without permission; reverse engineering, decompiling, or disassembling our software or systems. Violations may result in immediate account suspension or termination without refund, removal of content, legal action, and reporting to relevant authorities. We reserve the right to investigate suspected violations and cooperate with law enforcement agencies.

Disclaimers and Limitation of Liability

TechForge Academy Services are provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, or accuracy of information. We do not warrant that our Services will be uninterrupted, error-free, secure, or free from viruses or other harmful components. We make no guarantees regarding employment outcomes, career advancement, skill acquisition, or certification acceptance by third parties. Course content is for educational purposes and should not be considered professional engineering advice. You are solely responsible for evaluating the accuracy, completeness, and usefulness of any information or materials obtained through our Services. To the maximum extent permitted by law, TechForge Academy, its affiliates, officers, directors, employees, agents, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, opportunities, or business interruption, arising from your use or inability to use our Services, even if we have been advised of the possibility of such damages. Our total liability for any claims related to these Terms or the Services shall not exceed the amount you paid us in the 12 months preceding the claim. You agree to indemnify, defend, and hold harmless TechForge Academy, its affiliates, officers, directors, employees, agents, licensors, and suppliers from and against all claims, liabilities, damages, losses, costs, expenses, and fees (including reasonable attorneys' fees) arising from: your use or misuse of our Services; your violation of these Terms or any applicable laws; your violation of any rights of third parties; any content you submit, post, or transmit through our Services; unauthorized use of your account resulting from your failure to maintain account security; or any disputes with other users. This indemnification obligation survives termination of these Terms and your use of our Services. Our Services may contain links to third-party websites, resources, or services not owned or controlled by TechForge Academy, including industry partners, equipment manufacturers, software providers, and educational institutions. We provide these links for your convenience but do not endorse, monitor, or assume responsibility for any third-party content, privacy practices, or terms of use. Your interactions with third parties are solely between you and the third party, and we shall not be liable for any damages or losses arising from such interactions. Termination and Suspension of Services

TechForge Academy reserves the right to suspend, terminate, or restrict your access to all or any part of our Services, with or without notice, for any reason, including but not limited to: violation of these Terms or our policies; suspected fraudulent or illegal activity; prolonged account inactivity; requests from law enforcement or regulatory authorities; discontinuation or modification of Services; technical or security concerns; non-payment of fees; or conduct that harms other users or our reputation. Upon termination, your right to access and use our Services immediately ceases, and we may delete your account and associated data, subject to legal retention requirements. Termination does not relieve you of obligations to pay outstanding fees or affect provisions of these Terms that by their nature should survive, including intellectual property rights, disclaimers, indemnification, and dispute resolution. Upon voluntary termination, you remain responsible for all fees incurred prior to termination, and no refunds will be provided unless required by law. General Provisions and Governing Law

These Terms constitute the entire agreement between you and TechForge Academy regarding your use of our Services and supersede all prior agreements and understandings. If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect. Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. We may assign or transfer our rights and obligations under these Terms without restriction, but you may not assign or transfer your rights without our prior written consent. These Terms are governed by the laws of the Republic of Kazakhstan, without regard to conflict of law principles. Any disputes arising from these Terms or your use of our Services shall be resolved exclusively in the courts of Almaty, Kazakhstan, and you consent to personal jurisdiction in such courts. We reserve the right to modify these Terms at any time by posting updated Terms on our website with a revised date. Continued use of our Services after changes constitutes acceptance of the modified Terms.
